Terms and Conditions

Welcome to Cyclea. These Terms and Conditions ("Terms") are an agreement between you and Cyclea LLC ("Cyclea," "we," "us," or "our") covering your use of the Cyclea mobile app and the website at www.cyclea.app (together, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Our Privacy Policy explains how we handle your personal and health information and forms part of these Terms.

Health and safety — please read this first

Cyclea is a wellbeing and educational tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.

Cyclea is not a contraceptive. Do not rely on Cyclea, its cycle forecasts, phase windows, ovulation estimates, or "fertile" indications to prevent or achieve pregnancy. It is not a substitute for contraception or for fertility care.

Cyclea's forecasts are statistical estimates calculated from the information you choose to log. Cycles vary naturally between people and from month to month, and many factors — illness, stress, medication, travel, hormonal contraception, and health conditions — can change them. Estimates may be inaccurate, and they will be less reliable when you have logged little data or when your cycles are irregular.

Always consult a qualified healthcare professional about your health, your cycle, contraception, fertility, pregnancy, or any symptoms that concern you. Never disregard or delay professional medical advice because of something you read or saw in Cyclea.

If you think you may have a medical emergency, contact your doctor or your local emergency number immediately. Cyclea is not monitored and must never be used to seek urgent help.

Who may use Cyclea

You must be at least 13 years old to use the Service. If you are between 13 and the age of digital consent in your country (up to 16 in parts of the EU/EEA), you may use Cyclea only with the involvement and consent of a parent or guardian.

By using the Service you confirm that you meet these age requirements, that you can enter into a binding agreement, and that you are not barred from using the Service under the laws that apply to you.

Your account

You are responsible for the accuracy of the information you provide when you register, for keeping your password confidential, and for activity that happens under your account. Please keep your email address current so we can reach you. Tell us at support@cyclea.app straight away if you believe someone has used your account without permission.

Accounts are personal to you. Do not share your account or use anyone else's.

Your content

You keep ownership of the content you put into Cyclea — your logs, notes, planner entries, username, display name, and profile photo ("Your Content").

You grant Cyclea a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content strictly to operate and provide the Service to you. This includes showing your username, display name, and profile photo to other users as described under "Friends and sharing" below. This licence exists only so we can run the Service; it ends when you delete the content or your account, apart from residual copies in routine backups that are removed on a rolling basis.

You are responsible for Your Content. Only upload content you have the right to use — for example, do not use a photo of someone else as your profile picture without their permission.

Community rules

Cyclea includes a friends feature, so other people can see parts of your profile. To keep it a safe and respectful place, you must not:

  • harass, bully, threaten, stalk, or abuse anyone;
  • upload or share content that is sexually explicit, violent, graphic, hateful, discriminatory, or otherwise objectionable;
  • impersonate another person, or misrepresent who you are;
  • upload content you do not have the rights to, or that infringes anyone's privacy or intellectual property;
  • send spam, chain messages, advertising, or solicitations, or use the Service to promote a product or service;
  • attempt to contact, groom, or solicit minors;
  • use the Service for anything unlawful, or to encourage unlawful acts or self-harm;
  • collect or scrape other users' information, whether manually or by automated means;
  • interfere with or disrupt the Service, probe or circumvent our security or rate limits, access accounts or data that are not yours, or access the Service by automated means or through unauthorised clients;
  • reverse engineer, decompile, or attempt to extract our source code, except where that right cannot lawfully be restricted.

Reporting problems and enforcement

If you see content or behaviour that breaks these rules, please report it. In the app you can report or block someone from their profile or from an incoming friend request, and you can email us at support@cyclea.app with the details. Blocking removes any connection between you and stops the two of you from finding each other or sending further requests.

We review reports we receive and act on them. Depending on what we find, we may remove content, restrict what an account can do, warn a user, or suspend or terminate an account. Where the situation involves a risk to someone's safety, or where the law requires it, we may also contact the relevant authorities. We are not obliged to monitor the Service, but we may review content to enforce these Terms and to protect our users.

Friends and sharing

The friends feature is optional and works by mutual consent — a connection exists only once both people accept it.

When you and another user are connected, they can see your username, display name, profile photo, cycle and period lengths, current phase, current cycle day, your phase windows (dates), and a compatibility "match score." They cannot see your daily logs, symptoms, moods, journal entries or notes, flow entries, planner, favourites, or email address.

You control this. You choose whose requests you accept, you can end a connection or block someone at any time, and your visibility setting controls whether other users can find you — new accounts start hidden until you choose otherwise. See our Privacy Policy for the full detail.

Editorial content

Cyclea includes articles, classes, recipes, meditations, and similar material, some of it produced by third-party contributors. It is general information for education and wellbeing only. It is not personalised medical, nutritional, or fitness advice, and it is not a substitute for professional care. Views expressed by contributors are their own. Before acting on anything you read — especially anything involving exercise, diet, supplements, or medication — speak to a suitable professional, and stop immediately if any activity causes pain or discomfort.

We may add, change, or remove editorial content at any time.

Our intellectual property

The Service — including the Cyclea name and logo, the app, the website, our software, design, and editorial content — belongs to Cyclea or our licensors and is protected by intellectual property laws.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app on a device you own or control, for your own personal, non-commercial use, in line with these Terms and any applicable app store rules. We reserve all rights not expressly granted.

Price and paid features

Cyclea is currently free to use. If we introduce paid features or subscriptions in the future, we will make the price and terms clear before you buy, and any purchase made through an app store will also be governed by that store's rules.

Changes to the Service

We are actively developing Cyclea, and we may add, change, suspend, or remove features. Where a change is significant and within our control, we will give you reasonable notice if we can. We may also discontinue the Service; if we do, we will give you notice and a reasonable opportunity to delete your account.

Ending these Terms

You may stop using the Service at any time. You can delete your account and all associated data from within the app at Profile → Account → Delete account, or by emailing support@cyclea.app. Deletion is permanent and cannot be undone. Abuse reports are the one exception: so that a report cannot be erased by deleting an account, we keep them in anonymised form, as described in our Privacy Policy.

We may suspend or terminate your access if you materially breach these Terms, if your use creates a legal or safety risk for others, or if we are required to by law. Where it is appropriate and lawful to do so, we will tell you why and, when the breach can be put right, give you the chance to do so.

When these Terms end, your licence to use the Service ends. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — continue to apply.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that cycle forecasts, phase windows, or ovulation estimates will be accurate or complete, that the Service will be uninterrupted, secure, or error-free, or that any defect will be corrected.

Nothing in these Terms excludes or limits anything that cannot lawfully be excluded or limited — including, for consumers in the EU/EEA, UK, Switzerland, Australia, New Zealand, and elsewhere, your mandatory statutory rights and any applicable consumer guarantees.

Limitation of liability

To the fullest extent permitted by law, Cyclea and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the Service.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim arose, or USD 100.

These limits do not apply to liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or to your mandatory rights as a consumer. Some jurisdictions do not allow the exclusions or limits above, so parts of this section may not apply to you.

Your responsibility to us

You agree to be responsible for losses we reasonably incur because you used the Service unlawfully, in breach of these Terms, or in a way that infringes someone else's rights. This does not apply to the extent the loss was caused by us, and nothing here affects your rights as a consumer.

Apple App Store

If you download the app from the Apple App Store, the following applies and, where it conflicts with the rest of these Terms, it prevails for that download:

  • These Terms are between you and Cyclea only, not with Apple, and Apple is not responsible for the app or its content.
  • Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the app.
  • Cyclea, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
  • Cyclea, not Apple, is responsible for investigating and resolving any third-party claim that the app or your use of it infringes that party's intellectual property rights.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Pinellas County, Florida will have jurisdiction over disputes.

If you are a consumer resident in the EU/EEA, the UK, or Switzerland, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts where you live.

Before starting a formal dispute, please contact us at support@cyclea.app — we would much rather resolve the matter with you directly, and most issues can be sorted out quickly.

Other terms

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets, subject to these Terms. These Terms, together with the Privacy Policy, are the entire agreement between you and Cyclea about the Service.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or on our website and update the effective date above. If you continue to use the Service after a change takes effect, you accept the updated Terms; if you do not agree, you can delete your account.
